Things to Do If You’re at Fault in a Car Accident in Georgia

Posted on April 28, 2025 By rehan.rafique No Comments on Things to Do If You’re at Fault in a Car Accident in Georgia

Crashes in Georgia were the second leading cause of death in 2020, and the leading cause of death in children aged 5-14. There were 1,664 fatalities in motor vehicle accidents that year, which placed the state at number four for traffic fatalities in the whole of the US. Fatalities rose to 1,797 by 2022, with 507 of them caused by alcohol-impaired drivers. Fulton County recorded the highest number of fatalities, followed by DeKalb County.

If you caused a car accident, in Georgia or anywhere else, it’s important to stay calm, follow the proper procedures, and take the necessary steps to handle the situation properly. Here are five things you should do if you are deemed at fault in an auto accident:

Admit Fault Only to the Authorities

Do not say you were at fault to the other driver or passengers, as that could be used against you later. Stick to the facts and do not speculate on fault until investigators make an official determination. Some states have a shared liability rule, so even if you were at fault, another driver in a multi-vehicle accident might share some of the blame.

Exchange Information About The Car Accident

Regardless of who the police say is at fault, you need to exchange insurance and contact information with the other driver. Get their name, phone number, address, license plate, make and model of their car, insurance details, and driver’s license number. This information is crucial for insurance claims and contacting the other driver later if necessary. If there are any witnesses, also ask for their contact information.

Seek Medical Attention if Needed

If anyone involved in the accident is injured, call emergency services right away. There are around 3 million whiplash cases each year, most of which are caused by car accidents. It’s critical to get medical attention for all parties as soon as possible. Don’t say no one needs medical care unless emergency responders have cleared the scene. Seeking timely medical care also documents injuries in case you need to file a lawsuit later.

Report the Car Accident

Inform your insurance provider about the accident as soon as you can, even if you don’t plan on filing a claim. The other party may make a claim against your policy, so it’s best for your insurer to know ahead of time. Provide all the details you can about how the accident happened.

Consult a Car Accident Attorney if You Were Injured in Georgia

Around 3-5% of car accidents lead to a lawsuit in the US, with 4% of them going to trial. Of those that do go to trial, 61% of cases are successful. An attorney can help protect your rights, deal with insurance companies on your behalf, determine fault and liability, file claims or lawsuits if warranted, and seek maximum compensation for your damages. They are adept at navigating the legal system and complex paperwork. James Goldstein,  a car accident attorney in Atlanta, GA, mentions that “having professional legal representation ensures you have an advocate fighting for your best interests”.

Being at fault in a car accident can create many legal, financial, and emotional hardships. However, taking responsibility, cooperating with authorities, seeking medical care, notifying your insurer, and contacting an attorney will help you handle the situation in the best way possible. Staying calm but proactive protects your rights and aids the recovery process.
